Stage 8. Living in it

A first home for the kids

An adult child in a second home on the parents' block is a first home with no deposit, no landlord and no commute to Sunday lunch. The law allows it without conditions: since 2022 a secondary dwelling may be occupied by anyone, and a child paying board is a domestic arrangement that costs the parents no tax and no capital gains exemption. The money saved is the point, and the government's first home schemes are built for the next step: the First Home Super Saver Scheme lets a saver put up to $50,000 of voluntary contributions through super at lower tax, the 5% Deposit Scheme removes lenders mortgage insurance, and Help to Buy puts the government in for up to 40% of a new home with a 2% deposit. None of the three can buy the backyard home itself, because the child would be buying a house they already live in on land they do not own.

What the law says about a child in the flat

  • Who may live there. Anyone, related or not, since 26 September 2022, in every Queensland council area. No condition on the approval ties it to family.
  • Board, not rent. A child paying toward the household's costs is a domestic arrangement under the ATO's rules: not the parents' income, no deductions, and the main residence exemption from capital gains tax is kept in full. Charge market rent and the flat becomes a rental for tax. Renting to family.
  • Tenancy law. Does not apply to a family member paying board. It applies the moment there is rent and an agreement.
  • The home stays the parents'. It cannot be sold off separately; it is part of the lot and the title. If the plan is for the child to own something, it is the next home, not this one.

What the backyard home costs the parents

The home and the install, which installed versus ex factory prices, and nothing in tax while a child pays board. The costs are not deductible either, because there is no income against them. When the child moves on, the same home becomes a rental, a parent's home or an office, and the tax rules of that use take over from that day. A home built as a Class 1a dwelling keeps all of those options; a studio does not. Class 1a or 10a.

The backyard home is the deposit-saving step that the schemes above assume has already happened. Two years in a second home at board instead of rent in the same suburb is a deposit, and the parents keep an asset that works for the next person. For a family with a block and a child who is not leaving the city, it is the shortest path from renting to owning that exists, and nobody has to move.

The rent the child is not paying. The rent calculator shows the RTA median for the postcode, which is the number a child saves each week by living in the backyard instead of a flat nearby.

Questions people ask next

Can my adult child live in a granny flat in Queensland?

Yes. Since 26 September 2022 a secondary dwelling may be occupied by anyone, in every council area, with no family condition on the approval. A child paying board is a domestic arrangement with no tax for the parents.

Can my child use Help to Buy to buy the granny flat?

No. Help to Buy and the other first home schemes fund the purchase of a home the buyer will own and live in. A secondary dwelling is part of the parents' lot and title. The schemes apply to the next home, and the backyard home is where the deposit is saved.

Does a child paying board affect the parents' tax?

No. The ATO treats a relative's payment toward household costs as a domestic arrangement: not income, no deductions, and the main residence exemption from capital gains tax is kept. Market rent changes that.
